Lahore, 1st march: Where did the government delegation reach after the decision of the Supreme Court?

According to the report of Baaghi TV, the federal government has decided to approach the Election Commission after the Supreme Court ruled on the presidential reference regarding the Senate election open ballot.

A delegation of federal ministers has reached the Election Commission. The government delegation includes Babar Awan, Fawad Chaudhry, Shafqat Mehmood, Shahzad Akbar, Shahbaz Gil and Faisal Javed.

The government delegation is to meet the Chief Election Commissioner. The government delegation is consulting the Chief Election Commissioner about the Senate elections.

Earlier, Accountability Advisor Shahzad Akbar called on Parliamentary Affairs Adviser Babur Awan. The meeting reviewed the key points of the Supreme Court decision and discussed the government’s strategy in light of the decision.

The Supreme Court has issued an 8-page opinion on the presidential reference. The Chief Justice of Pakistan has written an opinion on the presidential reference regarding the open ballot.

The Supreme Court in its written opinion said that the vote was never acted in an ideal manner. The voting process is tampered with according to eligibility requirements.

Justice Yahya Afridi said in the dissenting note that the question asked in the reference was not of legal nature, the President’s question does not fall under the category of Article 186, the President’s reference is sent back without any reply.

The Supreme Court in a written decision said that the Election Commission should use modern technology to curb corrupt practices. All measures should be taken to make the Senate elections transparent, the secret ballot process is tampered with according to electoral requirements.

The Senate elections are held under the Constitution. Under Article 222, Parliament has the power to legislate in election matters. The Constitution makes it clear that Parliament does not influence the powers of the Election Commissioner by any legislation.

The court said in a written opinion that it is the responsibility of the Election Commission to conduct transparent and fair elections, it is also the responsibility of the Election Commission to take steps to prevent corrupt practices in the electoral process.

The Election Commission should fulfil its constitutional responsibilities. The Constitution has also given the Parliament the power to stop corrupt practices and other illegal activities. Legislation cannot reduce the powers vested in the Election Commission.

The Federation of Pakistan and all provinces are constitutionally bound to assist the Election Commission. As far as the secret ballot is concerned, the Supreme Court has responded in its decision.

In a 1967 court decision, the Supreme Court ruled that the secrecy of the vote was not permanent. The Election Commission used all available resources and technology to hold Senate elections.

It should be noted that due to the Senate elections on March 3, political activities have intensified. On the one hand, the government has intensified contacts with its allies and on the other hand, the opposition parties have also joined hands.
