ISLAMABAD – October 7, 2025: The Islamabad High Court (IHC) has been requested to halt the trial court proceedings in the Toshakhana-II case against Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan and his wife Bushra Bibi, pending a final decision on their acquittal petitions.

The plea was made by Barrister Salman Safdar, counsel for the PTI founder, before Justice Raja Inam Amin Minhas during Friday’s hearing at the IHC.

Safdar urged the court to restrain the trial court from announcing its verdict, stating that the proceedings were being rushed without allowing the defence adequate opportunity to complete its arguments.

“There are 35 witnesses in the case. Nineteen have testified so far, and the court has already moved toward questioning my client under Section 342,” said Safdar. “If the trial court announces its decision without a stay, my arguments will have no meaning.”

The lawyer emphasized that the case had already been probed by multiple agencies — including the Election Commission of Pakistan (ECP), the National Accountability Bureau (NAB), and the Federal Investigation Agency (FIA) — which, he said, constituted a violation of double jeopardy, as no individual can be punished multiple times for the same offence.

He also recalled that after Bushra Bibi’s acquittal in one Toshakhana reference, she was re-arrested outside Adiala Jail, calling the move an abuse of power.

Justice Minhas questioned the defence regarding alleged misuse of authority and referenced previous judicial decisions related to bail and prosecution conduct. Safdar cited the Hassan Aurangzeb case, in which Justice Miangul granted bail to both accused, arguing that similar legal principles applied here.

Responding to court queries, Safdar clarified that his client faced accusations of receiving several gifts, including jewelry and luxury items, but maintained that all were publicly declared and lawfully retained as per Toshakhana rules.

He argued that a criminal case could only be made if a person hid such gifts — not when the items were voluntarily disclosed by the accused.

“If someone admits to receiving a gift transparently, that does not constitute concealment or fraud,” he asserted.

Safdar further informed the court that Imran Khan had already been convicted in the Toshakhana-I case earlier this year, and that the IHC division bench had suspended that sentence in January 2024. The Toshakhana-II case, he said, was a continuation of political targeting under a new title.

Justice Minhas directed Barrister Safdar to submit references to all related court rulings, including those cited during arguments, before the next hearing. The judge said the court would review the record before making any interim order on the request for stay.

The court subsequently adjourned the hearing, with the next date to be announced later.
