Hijab controversy: Case referred to larger bench I Baaghi TV

Decision regarding the hijab row controversy in Karnataka has now been referred to a larger bench by the Karnataka High Court on Wednesday, a day after a face-off over the right to wear religious headscarves prompted educational institutions to close down for three days.

“These matters give rise to certain constitutional questions of seminal importance in view of certain aspects of personal law,” the judge hearing the case stated, referring it to a panel of judges to be led by the Chief Justice of the Karnataka High Court, Ritu Raj Awasthi. The developments occurred after protest by six teenage students at a government-run college over wearing headscarves spread to other colleges.

“In view of the enormity of questions which were debated, the court is of the considered opinion that the Chief Justice should take over the case and decide accordingly if a larger bench can be constituted in the subject matter,” Justice Krishna S Dixit said.

“The bench was also of the view that the interim prayers should also be placed before larger bench that may be constituted by Chief Justice Awasthi exercising his discretion,” he added.

The standoff in the Karnataka had been brewing for days until it took a violent turn of events in Tuesday, forcing policemen to fire tear gas at the crowd at one government-run campus. Heavy police forces were also seen near some schools.

Chief Minister Basavaraj Bommai appealed for calm after announcing all high schools in the state to be closed for three days. Some politicians think that this is no more than a public stunt to divert the general public’s attention from elections.

“It’s basically politics. All this is happening because the state assembly elections are due next year,” Karnataka Education Minister Nagesh told the international media.
