Ismat Adamjee granted bail because of provision in law granting women the privilege

Oct 22, 2021: The Supreme Court on Friday issued its written order on the bail application of Ismat Adam Gee, mother of Zahir Jaffer, the main accused in the Noor murder case.

The apex court had on Monday granted bail to Asmat after challenging the rejection of his bail application by the Islamabad High Court (IHC). A similar petition filed by Zahir’s father, Zakir Jaffer, was rejected.

Read the verdict, “The bail application has been accepted under a sub-section of section 497. The law allows women to get bail even if they are suspected of committing a non-bailable offense. According to the verdict, Asmat has been directed to submit a bond of Rs 1 million against bail. “Bail will be revoked in case of misuse of release, delay in trial or induction of witnesses in the case,” the decision said.

The three-page decision was written by Justice Umar Ata Bandial. Separately, the Supreme Court rejected the bail application of Asmat’s husband Zakir.

In addition, the Supreme Court’s decision further said that the IHC’s order to complete the trial within two months should be upheld.

Earlier, the IHC had rejected the bail application filed by Zahir’s parents in the case. Zakir and Ismat had filed bail applications in the case stating that they had nothing to do with Noor’s murder, while the police challan presented in the court said that if Zahir’s parents informed the police in time. By doing so, Noor could have been saved.

Zahir Jaffer, the main accused in Noor Makadam’s murder, was formally charged by the Sessions Court on October 14. In addition to Jaffar, two employees of the family – Jamil and Jan Mohammad – were also charged, along with Tahir Zahoor, the chief executive officer of Therapy Works, and eight others.

Zahir Jaffar Noor Makadam is the main accused in the murder case. The heinous murder in which Makadam was beheaded took place in the house where he was living.

Islamabad police arrested accused Zafar Jaffer from his home on the night of July 20, where, according to Noor’s parents, they killed him with a sharp instrument and beheaded him.

The horrific incident sparked a nationwide campaign for justice, with #JusticeforNoor becoming a top trend on Twitter.
