The Lahore High Court (LHC) Judge Justice Ali Zia Bajwa on Friday dismissed a petition filed against a lady who remarried without finishing her iddat (period a Muslim lady needs to see after the disintegration of marriage).

A case was documented in the LHC wherein the applicant, Amir Baksh, recorded an instance of fornication (Zina) against his ex Amina and her new spouse Ismail.

The petitioner, in his application, said that his ex Amina singularly took a decision of invalidating the marriage from the court and sealed the deal with Ismail the following day. He named the new marriage “invalid and void” just as Zina.

The LHC excused the request by saying that a lady remarrying without the finishing of her iddat can’t be named Zina.

It added that regardless of whether the applicant’s position is acknowledged, such a marriage can’t be considered batil (invalid). Nonetheless, the court said, the demonstration of remarrying without the culmination of iddat would be thought of “bad or unpredictable.”

The court additionally expressed that a couple wedding without the lady finishing her iddat can’t be accused of the wrongdoing of Zina.
