Presidential reference against Justice Qazi declared unconstitutional
Islamabad, 23rd October: Presidential reference against Justice Qazi Faiz has been declared unconstitutional.
The Supreme Court has issued a written judgment regarding Justice Qazi Faiz Issa, which was written by Justice Umar Atabandial and consists of 224 pages.
Declaring the presidential reference unconstitutional, the verdict said that the presidential reference against Justice Qazi Faiz was a violation of the Constitution and the President failed to exercise his discretionary powers as per the Constitution.
According to the decision, the impartial judiciary is part of the values of any society. It is a constitutional and legal right to file review petitions against the decisions. In the Faizabad sit-in case, the review petitions cannot be termed as malicious.
The verdict, while directing action on disclosure of confidential information and secrets, said that Justice Qazi Faiz is guilty of disclosing confidential information of his wife’s tax return. Authorities are also complicit in the release of information.
The Supreme Court has directed the Chairman FR to submit the compliance report to the Registrar within 15 days and the FR should fully abide by the law in the case of arrest of Faiz Issa.
Regarding accountability, the decision made it clear that the accountability of judges is the need for a democratic and vigilant society.
