IHC allows India to provide another counsel for Kulbhushan Jadhav #Baaghi

ISLAMABAD: The Islamabad High Court (IHC) has reportedly allowed India another chance, till April 13, to provide counsel to Kulbhushan Jadhav.

According to details, a larger bench comprising of Chief Justice Athar Minallah, Justice Amir Farooq, and Justice Mian Gul Hassan Aurangzeb, on the request of the Law Ministry has agreed to provide government counsel to Kulbhushan Jadhav to implement the decision of the International Court of Justice (IHC). 

The Attorney General apprised India of the progress of the contacts made on Jadhav and said that India wants the court proceedings in Pakistan to stop so that it can appeal to the International Court of Justice. Chief Justice Athar Minallah remarked that the decision of the ICJ expressed confidence in the Pakistani court and the matter of reviewing the death penalty was left to Pakistan, perhaps India did not understand the decision properly.

The court inquired, has any Act been passed on this matter? Attorney General Khalid Javed Khan said the Act was passed in December last year, according to which the law ministry could file such a petition against foreigners. However, India has no interest in providing a lawyer for Jadhav. According to the Attorney General, India is of the opinion that neither was Pakistan’s first law right nor is the new act. In addition, the Attorney General said that India wants to humiliate Pakistan, but praise to be Allah Almighty, Pakistan has always thwarted Indian tactics with its actions. 

In response, CJ Minallah said that India should consider Kulbhushan Jadhav as a human being. He is an Indian citizen but we consider him a human being.

According to reports, the Attorney General remarked that India only considers Kulbhushan Jadhav an “asset”, not a human being. When India sent Jadhav to Pakistan, it changed his identity from Kulbhushan Jadhav to Hussein Mubarak Patel. The Attorney General added that when such intelligence officers are sent, there is a “design” behind it. India is against court proceedings in Pakistan because its plans will fail. 

The IHC reportedly moved to grant another opportunity to India, stating that India should consider Kulbhushan Jadhav as a human being and decide its position for his legal counsel, respectively. 

Who is Kulbushan Jadhav?

Indian national Kulbhushan Sudhir Jadhav was born in the city of Sangli in the Indian state of Maharashtra on April 15, 1969. Jadhav joined the Indian National Defence Academy in 1987 and was commissioned in the engineering branch of the Indian Navy in 1991; he is still serving as a Commander.

He was picked up by the Indian spy agency Research and Analysis Wing (RAW) at the end of 2013 and has been directing various subversive activities in Karachi and Balochistan. RAW gave him the pseudonym Hussein Mubarak Patel to conceal his real identity. According to earlier reports, Jadhav’s job was to hold meetings with Baloch insurgents and collaborate with them to carry out criminal activities, such as the killing and/or maiming of Pakistani citizens.

Jadhav who was arrested on March 3rd, 2016 was in pursuit of targets set by his RAW handlers. During interrogation by Pakistan’s investigation agencies, Jadhav revealed that at Wadh, he was in contact with Haji Baloch, who provided financial and logistic support to the *Baloch separatists and the Islamic State network in Karachi. Jadhav also revealed that the masterminds behind the Safoora bus attack were in contact with Haji Baloch. It is pertinent to note that the Safoora bus attack led to the assassination of 45 Ismaili passengers by gunmen.

Jadhav added that he had met Haji Baloch several times, sometimes for planning sectarian violence in Karachi and the rest of Sindh. Upon information provided by Jadhav, Pakistani security agencies arrested hundreds of undercover operatives working to sabotage peace in Pakistan.
