ISLAMABAD, July 30 (Online Int’l): Islamabad High Court (IHC) has fixed for hearing a petition filed by the government for the appointment of a legal representative for Indian spy Kulbhushan in connection with the implementation of the verdict of International Court of Justice (ICJ).

A  bench has been constituted under Chief Justice IHC Athar Minallah to hear the case on August 03. The federation  through defence secretary and judge advocate general GHQ have been made respondents in this petition. The petitioner told the court that Kulbhushan had refused to file a petition against his sentence.

The petitioner also took the plea that Kulbhushan cannot appoint his lawyer in Pakistan without the assistance of India. India too is avoiding to enjoy facility of ordinance. The petitioner prayed the court to appoint a legal representative of Kulbhushan. The Court should give an order so that Pakistan’s obligation could become fulfilled as per the ICJ verdict.

It is pertinent to mention here that the government had filed the petition under the ordinance which was recently promulgated. Indian Navy officer Kulbhushan was arrested from Balochistan under the charges of spying on March 3, 2016. India had resorted to the ICJ in connection with the release of Kulbhushan. The ICJ had ordered that Kulbhushan should resort to Pakistan courts for his release and fair trial.
