Judge’s alleged involvement in misuse of powers, Petition filed in SC

ISLAMABAD, August 28 (Online): Petition has been filed in Supreme Court (SC) against Sohail Muhammad Leghari, district and sessions judge Sukkar for his alleged involvement in misuse of powers and unnecessary transfer of cases.

The petition has been filed by a citizen Muhammad Sharif taking the plea that transferring of case from one court to other court has become a routine  in lower courts. Country’s judicial system has gone  annihilated due to Qabza mafia pressure on judicial system. 2 FIRs of murder were registered against the accused Rao Shakir. But the trial of the case has not been started despite lapse of 6 years. The lawyers and Qabza mafia are supporting the accused.

The petitioner further said Judge Sohail Leghari transferred the case to the court of Tariq Ali Sanghro by misusing his powers. Ijaz Ahmad and Manzoor Hussain Ansari who had filed application for transferring of case have nothing to with this case. District and Sessions Judge Sohail Leghari is an incompetent judge who can not give verbal orders even. The language used in the application seeking transfer of case and the orders is the same. This shows nexus between judge and mafia. Judge Sohail Leghari has no powers to transfer the case.

He said non initiating the trial of case is tantamount to stage mockery of judicial system. Under section 528 of criminal code district and sessions judge is not authorised to transfer the case to any additional session’s judge.  The training of Judge Sohail Leghari from judicial academy is also suspicious.  The learned judge prefers personal interest to law.

The petitioner has prayed the court to set aside Judge Sohail Leghari August 22, 2020 orders on transferring the case declaring it malafide. Orders should be issued to registrar Sindh High Court and member inspection team-2 to hold inquiry against Judge Sohail Muhammad Leghari. Registrar Sindh High Court and district and sessions judge Sohail Muhammad Leghari be directed to present all the record in respect of case 2018/34 in Supreme Court.

He further prayed that Judge Sohail Muhammad Leghari be restrained from issuing any order against him till the decision of the case. Orders be also issued to arrest the accused persons immediately who were named in FIR which was registered six years back.

Registrar Sindh High Court, Member Inspection Team-2, district and sessions judge Sohail Muhammad Leghari, additional and sessions judge Sukkar Islam ul Haq Arain and Tariq Ali Sanghro have been made respondents in the case.
