Baaghi TV: The government’s resolution to extend the ordinance will be tabled in the National Assembly on Monday. The term of the ordinance will be extended by 120 days. The ordinance, issued in May, will expire this week. Under the ordinance, Kulbhushan Yadav has the right to appeal.
On July 7, an ordinance granting the right of appeal to Indian spy Kulbhushan was introduced in the National Assembly. Babar Awan, Advisor to PM Imran Khan on Parliamentary Affairs, had introduced the International Court of Justice and Review and Reconciliation Ordinance 2020 in the National Assembly on Kulbhushan Yadav.
It is clear that the implementation of the decision of the International Court of Justice regarding the sentence of Indian agent Kulbhushan Yadav. The government has filed a petition in the Islamabad High Court to meet the requirements of the fair trial.
The Ministry of Law and Justice has approached the Islamabad High Court. The government filed the petition under a recently issued presidential ordinance. The petition filed in the Islamabad High Court has requested the court to appoint a legal representative on behalf of Indian agent Kulbhushan Yadav in the national interest.
The petition further said that Kulbhushan Yadav had refused to appeal against the sentence. Kulbhushan cannot appoint a lawyer in Pakistan without Indian assistance. India is also reluctant to avail the facility under the ordinance.
Hearing a petition filed by the government on September 3, the apex court gave India another chance at consular access to its agent. India ordered to send order to Islamabad High Court. Islamabad High Court adjourned the case till October 6.
Attorney General Khalid Javed appeared in court. The Attorney General said that India is trying to defame Pakistan. In my view, there are two possible cases, one of which is for the court to appoint a lawyer for Kulbhushan. The second case is to wait for the Indian response. Granted access for the third time but Kulbhushan Yadav refused. India has no interest in fighting the case.
It should be noted that Indian spy Kulbhushan Yadav was arrested on March 3, 2018 from the Pakistan-Iran border area. The Indian spy was serving as a serving officer of the Indian Navy and an agent of RAW.
