LHC grants good news to Jahangir Tareen

Lahore, 23rd November: Jahangir Tareen gets good news from the court.

According to Baaghi TV, the Lahore High Court suspended the notice sent by the Federal Board of Revenue (FBR) to Jahangir Tareen’s JDW Sugar Mills.

Justice Jawad Hassan of Lahore High Court heard the petition of Jahangir Tareen against the selection of JWD Sugar Mills for audit. The court suspended the notice sent by the FBR to Jahangir Tareen Sugar Mills.

JWD Sugar Mills said in the petition that in the light of the report of the Sugar Inquiry Commission, an audit of the last 5 years of the Sugar Mills has been started. According to the law, Inland Revenue does not have the authority to audit the previous years of the Sugar Mills.

JDW Sugar Mills lodged objections with the Commissioner of Inland Revenue against the audit notice of previous years, which rejected the objections without hearing the position.

The petitioner contended that the rejection of the objections of the Commissioner of Inland Revenue was a violation of Articles 4, 10A and 4 of the Constitution, therefore the court is requested to declare the action taken in the light of the Sugar Inquiry Report as unconstitutional.

Tax should be abolished and FBR should be stopped from taking action against Sugar Mills. Notices issued to the Federal Government and FBR petitioner should be suspended till final decision.

The federal cabinet had on June 23 approved action on the report of the Sugar Commission. The Prime Minister directed FBR, NAB, SECP and FIA to investigate.

On the directive of the Prime Minister, Advisor on Accountability and Home Affairs Shehzad Akbar sent letters to Governor SBP, Competition Commission and three provinces.

The text of the letter said that the FBR should investigate the anonymous transactions of sugar mills and NAB should determine the culprits in the light of the findings of the sugar commission. The NAB was asked to investigate the financial affairs of the sugar mills and the owners.
