Peshawar, July 10 (Online Int’l): In pursuance of Section 26 (c) of the Khyber-Pakhtunkhwa Epidemic Control and Emergency Relief Ordinance, 2020 (Khyber Pakhtunkhwa Ordinance No.XI of 2020), read with declaration of emergency throughout the Khyber Pakhtunkhwa due to Coronavirus (Covid-19) vide Health Department Notification, the competent authority has ordered that during the emergency, no employee or worker shall be laid off, terminated or removed from service on account of his absence furlough or non-performance of duties owing to closure of any establishment, shutdown or other measures related to epidemic control, in the area failing within the limits of smart lockdowns.

Non-compliance of the above order will invoke section 27 of the Ordinance and the violator shall be punishable with on the spot fine which may extend upto rupees one million or attachment of movable, immovable, or perishable property or both on a complaint made by the aggrieved person in writing to an officer authorized under section 35 of the Ordinance.

Furthermore, according to section 3 of the Khyber Pakhtunkhwa Payment of Wages Act, 2013, every employer including a contractor, sub-contractor, headman, and middle man of agent shall be responsible for the payment to the persons employed by him of all wages required to be paid under this act.

The Government has authorized the Deputy Commissioners concerned under section 35 of the Ordinance to take cognizance of non-compliance under section 26 of the Ordinance ibid. Besides, inspectors of factories are appointed under section 11 of the Khyber Pakhtunkhwa Factories Act 2013 and inspectors of shops appointed under section 26 of the Khyber Pakhtunkhwa.

Shops and Establishment Act 2015 shall take cognizance under the payment of wages/Act.2013. It was notified by the Labour Department, Government of Khyber Pakhtunkhwa.
