Petition to be submitted in lieu of protecting Pakistan’s Constitution

Lahore: Petition is being submitted by Wing Commander (Retd.) Muhammad Nawaz Asim L.L.M for enforcement of Article 245 of the Constitution of Pakistan. 

According to reports of Baaghi TV, Article 25 of the Constitution of Pakistan states that all citizens are equal before the law and are entitle to equal protection from the law. This means that there should be no discrimination amongst the citizens holding any position be it an executive post, judiciary, armed forces and/or other state institutions. The petitioner has stated that on the basis of Article 25, the courts have been embroiled in prejudiced decisions due to the appointment of judges through nepotism and political fraternity, which has led to the favour of money launderers and other corrupt officials since there is no equal justice for all.

According to the petitioner, the state institutions have been monopolized for personal and nefarious interests by disregarding Article 25 of the constitution. An example of which is the case pertaining to Justice Qazi Faiz Esa, a living example of how mafias operate in Pakistan. According to reports, the judiciary of Pakistan has violated the fundamental interests of the citizens. The petitioner is of the opinion that the pursuit of the 10 Supreme Court judges is against the justice system built to protect the mafia against the crooked use of constitutional powers.

Moreover, the petitioner is of the view that the rights of the people of Pakistan are being usurped by our own judiciary. According to Wing Commander (Retd.) Muhammad Nawaz Asim L.L.M, when state institutions fail to deliver in accordance with the spirit of the Constitution, it becomes mandatory for the Prime Minister to include the President to save the country from any disgraceful situations.

The petitioner is of the opinion that since the judiciary is working in violation of the Constitution of Pakistan, it has failed to protect the inalienable rights of the people by means of verdicts of the morally corrupt judges and is a failure of the important state institutions. Moreover, the petitioner is of the view that Pakistan as a state and its people are suffering the brunt of the financial emergency caused in lieu of the moral degradation, due to which FATF has kept Pakistan in its grey list for.

Moreover, in the petition which is soon to be submitted, the petitioner has urged the President of Pakistan, Dr. Arif Alvi, to use his constitutional powers in the interests of the state and its people and to eradicate corruption within Pakistan.
