Qatar Airways has launched international mediation for 5 billion in compensation from four Arab countries such as UAE, Saudia Arabia, Egypt and Bahrain. It was for blocking the use of airspace and removing it from its markets.

According to the Qatari broadcaster, Qatar Airways said in a statement that with the aim of shutting down its operations of four countries in of Qatar Airways have increased the value of the company’s investment and it has also severely damaged its global operations.

The airline’s chief executive officer (CEO), Akbar al-Baqar, said the decision by these states to bar Qatar Airways from operating in their countries and using their airspace is violation against civil aviation conventions and numerous agreements. These agreements were bound to be followed.

“After three years of trying to resolve the dispute amicably through negotiations, we decided to issue notices of arbitration,” he said,”We have used all legal means to protect our rights and to fully compensate for violations.”

He said the countries that imposed sanctions must be held accountable in the aviation sector for their illegal actions because they have failed to comply with multilateral agreements and international law. Qatar Airways said it had sought compensation through four investment mediators under three agreements, including the Arab Investment Treaty.

Last week, the International Court of Justice (ICJ) upheld Qatar’s position against Saudi Arabia, Bahrain, Egypt and the United Arab Emirates (UAE) on the issue of airspace restrictions. The president had said that the appeals of Bahrain, Egypt, Saudi Arabia and the United Arab Emirates against the decision of international civil aviation were rejected.

The court said the matter falls under the jurisdiction of the International Civil Aviation Organization (ICAO). Qatar welcomed the ICJ’s decision, saying: Countries that block airspace will face “justice” for violating international aviation laws.

It is to be noted that the ICAO had decided in 2018 that resolving the dispute between Qatar and other parties over the issue of air sovereignty falls under the jurisdiction of the ICAO. It rejected the decision and said that he did not agree with the ICAO and that the decision by the said body was clearly based on error where the parties were not properly heard.

Qatar, in its case to the ICAO, had said that its four neighboring countries were violating the international convention that gives foreign passenger planes complete freedom to fly over its airspace. The court had asked the court to quash the ICAO’s decision.

The four Arab states abruptly severed ties with Qatar in June 2017, accusing Doha of backing extremists, while Qatar vehemently denied the allegations. Extensive measures were taken to prevent them from using their airspace, closing Qatar’s only land border with Saudi Arabia and deporting Qatari nationals.
