South Africa accuses Israel of ‘genocidal acts’ in Gaza, files case in ICJ

South Africa has filed a case against Israel at the International Court of Justice (ICH) on Friday, for what it has said are “genocidal” acts in Gaza/Palestine.
According to Al Arabiya reports, in the application to the ICJ, South Africa has alleged violations by Israel under the Genocide Convention – which considers Genocide to be a crime that can take place between times of war or even in times of peace – a human rights treaty adopted by the General Assembly of the United Nations in December 1948 and signified the international community’s commitment to “never again” commit atrocities such as those committed during World War II.

In a statement, issued by South Africa it is said: “Israel has engaged in, is engaging in and risks further engaging in genocidal acts against the Palestinian people in Gaza”. South Africa has further taken the stand that Israel has been acting with the “requisite specific intent… to destroy Palestinians in Gaza as part of the broader Palestinian national, racial and ethnical group”.
Israel, on the other hand, has not only rejected this stance calling it a baseless blood libel with no legal merit but has also determined that its actions are in compliance with international law in its war against Hamas, in Gaza. A statement issued by Israel’s Foreign Ministry reads: “South Africa is collaborating with a terrorist group that calls for Israel’s destruction”. The statement continues: “The people of Gaza are not an enemy of Israel, who is making efforts to limit harm to non-combatants”.

It is pertinent to mention that in over eighty days since the war was started, on October 7, Israeli aggression has left many parts of northern Gaza in ruins killing thousands of women and children and isolating the surviving civilians through limited resources including food and water, medical aid and essentials infrastructure. The attack in October left approximately 1,140 dead – of which many were civilians – and 250 Israeli hostages captured by Hamas.
On the other hand, Israeli attacks have since claimed the lives of more than 21,500 Palestinians of which most were women and children as confirmed by the Palestinian health ministry.
