Aryan Khan Drugs Case: What can be the maximum punishment?

Mumbai: Bollywood actor Shah Rukh Khan met his son Aryan Khan, who was arrested from a rave party for consuming and possessing banned drugs, at the Narcotics Control Bureau (NCB).

Following the hearing of 23 year-old Aryan Khan’s bail application on Monday, the court remanded him in the custody of the NCB till Thursday. Apart from Aryan, eight others have also been arrested in the case.

According to Indian media reports, Khan allegedly became very emotional during his first meeting with his father and cried uncontrollably. Shah Rukh Khan had sought permission from NCB to meet his arrested son Aryan Khan. On the other hand, according to Indian media reports, Aryan Khan could be sentenced to 20 years.

Khan has been arrested by the NCB under sections 8C, 20B, 27, and 35 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985. If convicted, so they can be sentenced to 6 months to 20 years.

Section 8-C of the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985, is a case of buying and selling drugs and if convicted, Khan could face up to 10 years in prison. Section 20-B is a case of possession of cannabis, hashish, and drugs and in this case, the sentence is up to 20 years. 

Therefore, if the allegation is proved against Aryan Khan, he could be sentenced to 20 years. Section 27, this section is imposed on the accused in case of possession of drugs, and in section 35 the accused has to prove his innocence.

It may be recalled that NCB arrested Shah Rukh Khan’s son Aryan in a surprise raid on a Rave party on a ship on the night of October 2, 2021. During the raid, NCB arrested Khan and his associate’s illegal/banned drugs were recovered. Later, during interrogation, Shah Rukh Khan’s son confessed to using drugs.
