The grossly negligent appointees of the government have once again brought humiliation and embarrassment for the country.

The executive, the judiciary and the army may lock horns in the most cruelest twist of circumstances. It is prayed that such situation be reversed soon and better sense must prevail.

The existence of our legal justice system is now taking grips of newly emerging political scenarios. The strengthening of courts is something that we all have been longing for perhaps Imran Khan’s insinuations about our judiciary in one of his speeches triggered and led to this conundrum.

The current fiasco regarding the suspension of COAS’s extension has once again put all activity in limbo. An application by some applicant over the issue of Bajwa sahib’s extension has put the wheels of justice in motion.

It is believed that the President of Islamic Republic of Pakistan, is the supreme commander of the armed forces, who is entrusted with all and absolute authority to make any change thereof.

Prima facie, one summary for the extension of the COAS from the Ministry of Defence should have been initiated after due dilligence and thorough deliberations. That is how it should have been routed.

It should have then come to the cabinet. The members of the cabinet making their recommendations thereof. They should have then given their piece of advice to the PM. The Prime Minister on endorsement should have forwarded the instrument to the president for its final approval.

According to article 243, this is the prerogative of the President in aid of Prime Minister’s advice. While I go forth to pen my words the matter is being dealt with in our courts as it proceeds, the decision hangs in the balance.

The discussion is becoming interesting, the provision for extending the Chief’s tenure be evolved and adopted with absolute clarity and without any ambiguity. The criterion has to be adopted.

The court is perhaps wanting to streamline the basis on which the Chief has to be appointed without ambiguity and the time period of this tenure has to be clearly mentioned. The probe of judges in order to elucidate the matter is believably for the better of this country.

No question has ever been raised over the issue of extension. Justice Mansoor’s quarry over the time frame is pertinent.

The amendments could be done on a condition to legislate laws. On this pretext the court should take a lenient view. After the court shows its leniency the government through an ordinance could bring all anomalies under the scope of law thus, paving way for a smooth sailing. The court has been adjourned till tomorrow.

The court has once again asked the attorney General that the summary presented before them was irredeemably flawed. They controverted the inclusion of extension and appointment according to article 255.

This is an inopportune time to start all this. I don’t feel happy when our next door neighbour is exploding with gleeful shaudenfrede. Army has sacrificed lot of their valorous jawaans and officers. Let’s not fall victim to foreign designs and create schmozel within our state organs.
