Distinguished Judgement Passed on Iman Aly’s Derogatory Remarks for Trans Community

Lahore, 12th August: A well-articulated and distinguished judgment was passed by the Pemra Council of Complaints on the derogatory and insensitive remarks made by actor/model Iman Aly.

According to details, the Pemra Council of Complaints, headed by Barrister Ahmed Pansota passed a distinguished judgment on Thursday regarding the condescending, derogatory, discriminatory and insensitive comments passed by actor-model Iman Aly.

According to reports, earlier in June this year, the actress equated being a transgender person with being unattractive, in an interview on TV with the famous host Vasay Chaudhry.

Explaining why she can’t take her selfies, Iman Aly said, “I can’t even take pictures of myself. Whatever angle I try, I think ‘aye haye, khusra‘.

Meanwhile, Aly’s remarks garnered a lot of criticism from social media users and the transgender community.

Her remarks, “aye Haye Khusra” targeted the entire Transgender community, being in violation of the Code of Conduct and Constitution of Pakistan.

Regarding the case, Barrister Pansota represented his client, Nisha Rao, the first transgender lawyer in Pakistan.

Meanwhile, a self-explanatory complaint under Section 26 of the Pakistan Electronic Media Regulatory Ordinance, 2002, was received from M. Kashif (Nisha Rao) through Barrister Khadija Siddiqui against ARY Digital.

The context of the complaint read, “A guest named Ms. Iman Ali in the program ‘Ghabrana Mana Hai‘ appeared and passed extremely insensitive, demeaning, derogatory, hateful comments, “Aye Hye Khusra” against the transgender community, which had disturbed the entire community.”

The complainant further said that belonging to an already marginalized community of Pakistan, while watching the program felt attacked, offended and insulted.

Barrister Khadija appeared before the Council argued that the statement by the model was problematic because it discriminated on the basis of artificial beauty standards and further insinuated that transgenders were ugly.

On the other hand, Conversely Council for the Respondent Mr. Ehtisham submitted that remarks by Iman Aly were general in nature and were not meant to hurt the feelings of the transgender community.

He further explained that Ms. Iman’s statement was inadvertent and denied violation of any provision of the Code.

Therefore, Pemra passed a significant judgment in this regard keeping in view the Shariah Law and Human Rights violation. The Council ordered that no content will be aired henceforth, which passes derogatory remarks about any sect, religion or community.

It further said that no content that contains an abusive comment that incites hatred and contempt against any individual or group of individuals on the basis of race, caste, sect, nationality, religion, culture, gender, age, mental or physical disability should be aired.

The Council announced the imposition of a fine of Rs 500,000 on the Respondent Channel under Section 26 (5) of the Ordinance. It further directed the channel to write an unconditional apology to the Complainant and the transgender community.
