Former Interior Minister Senator Rehman Malik Weighs in on Presidential Ordinance

20th February 2021: Former Minister for Interior Senator Rehman Malik, has weighed in on the issue of the Presidential Ordinance outside the parliament house. There are many challenges in Pakistani politics, not least of which is that of horse trading, he observed.

He said that horse trading has not appeared now. It has always been around. The government knew this and had ample time in which to address the issue. Instead of going for legislation, the government chose to go for a presidential ordinance in a hurry. There is a clear statement in the constitution of Pakistan regarding senate elections, he said.

“The constitution very clearly stipulates a secret ballot. Under which law has the government issued a presidential ordinance?”

The Presidential Ordinance is against the section of the constitution that deals with senate elections, he went on. At this rate the President of Pakistan might choose to change the term of prime ministership. It is not acceptable for the President to issue an ordinance in any matter that he wishes, he said. No ordinance can be issued that violates the constitution, he said. If a bill related to the senate elections was already present in the parliament, what was the need of a presidential ordinance, he asked. The said bill has gone through the national assembly and senate committees and now when it is in the national assembly, the government has come up with a presidential ordinance, he said.

It seems like the government has no faith in its own members of national assembly. Such ordinances can only set bad precedents. If we don’t show loyalty to the constitution at this time, democracy will be weakened and the people’s faith in its representatives will dwindle.

In the morning session of the Senate, members paid rich tributes to the late Mushahidullah Khan. Senator Mushahidullah Khan has always been loyal to the party, it was said. Senator Mushahidullah Khan stood by the party in every difficult hour. After Mushahidullah Khan, his son was given a ticket to the Senate.
