IHC Issues Directives in Missing Engineer Recovery Case

ISLAMABAD, August 06 (Online Int’l): The Islamabad High Court while maintaining its orders on the recovery of a missing citizen within a month has issued directives not to implement its order on imposition of fine and sacking of defence secretary, interior secretary, IG Police Islamabad and SHO till the next hearing in recovery of missing engineer Suleman Farooq case.
The court issued these orders on intra-court appeal filed by IG Police Islamabad and SHO Lohi Bhir police against court verdict regarding imposition of fine and termination of their service. The court has issued notices to the respondents and summoned a reply from them.
Advocate General (AG) Islamabad Niaz Ullah Niazi and Qaisar Imam advocate appeared in the court Thursday. Principal Secretary to the Prime Minister, Secretary Establishment division, interior secretary and Professor Muhammad Rafiq Chaudhry have been made respondents in the intra court appeal.
The petitioners have prayed the court to nullify the verdict of single bench of IHC besides issuing the orders for stopping the implementation of its single bench order till the decision of intra court appeal. They contended that the single bench gave a decision by ignoring efforts made for recovery of the abducted person. Can a government employee be sacked without an inquiry, charge sheet and departmental action? Can a fine amounting to Rs 2 million be slapped on any side of the case under article 199 of the constitution?
A single bench of IHC led by Justice Mohsin Akhtar Kiyani had ordered for dismissal from service and imposition of fine on interior secretary, defence secretary, IG police and SHO on the petition filed by Professor Muhammad Sharif Chaudhry father of missing person Suleman Farooq seeking court orders for recovery of his son.
