According to sources, the Lahore High Court has rejected a petition filed by singer Meesha Shafi against witnesses, to stay the defamation suit filed by actor and singer Ali Zafar, for alleged violation of cyber crime laws.

According to sources from the Lahore High Court, Justice Chaudhry Masood Jahangir said in his judgment that, the case against the petitioner was registered 2 years ago. Which is to be decided on the basis of its own merit.

The Lahore High Court judge remarked that the scope of civil litigation is the enforcement of civil rights of the parties involved. However, the purpose of criminal proceedings is to punish the culprit if found guilty.

The judge remarked that the statements of some of the petitioner’s witnesses had already been recorded. Therefore, the position of the petitioner’s counsel that his witnesses are reluctant to appear because of the second trial does not constitute any justification for stopping the trial.

Dismissing the petition, the judge also remarked that the trial court was quite correct in rejecting the petitioner’s request to stay the proceedings.

On the other hand, Additional and Sessions Judge Yasir Hayat will hear the defamation case on November 7th, in which Meesha Shafi has been directed to present evidence. Earlier, on October 10th, Meesha Shafi had filed a petition in the Lahore Sessions Court seeking stay or adjournment of the defamation suit against him for the time being.
