The Islamabad High Court heard a petition filed by a citizen in the public interest to ban online gambling and take action against the persons involved.

Justice Raja Inam Amin Minhas of the Islamabad High Court heard the petition. Barrister Imran Rashid appeared in the court on behalf of the petitioner. After hearing the petition, the Islamabad High Court issued notices to the federal government, PTA, FIA, State Bank, and PEMRA. During the hearing, Barrister Imran Rashid argued in the court how gambling apps ignore banking laws by using digital wallets, through which money laundering and financial fraud are committed. Citing constitutional, legal and Islamic prohibitions, Imran Rashid requested the court to close these apps, stop their advertisements on social media and impose strict financial controls.

The petition filed in the Islamabad High Court said that the work of those facilitating digital payments in the illegal gambling business should also be interfered with. Online gambling apps use indirect methods to process payments; they provide the local account number of an unknown third party to deposit money in the gambling account. After receiving the money, the gambling apps credit it to the user’s account so that she/he can gamble. When gambling money is won, the payment is made to the user’s account in the same way. This entire process also helps in money laundering and tax evasion by avoiding banking restrictions and legal scrutiny. Section 37 of the PECA Act empowers the PTA to block illegal gambling platforms, the Pakistan Telecommunication Authority has failed to assert its authority in this regard. The Anti-Money Laundering Act imposes heavy fines on those facilitating illegal transactions and the State Bank of Pakistan has failed to regulate the financial ecosystem.

The Islamabad High Court has been requested to issue orders to ban online gambling apps and their advertisements in Pakistan. The State Bank of Pakistan should be ordered to impose financial control on digital platforms to stop gambling transactions. The petition says that the PTA should be ordered to stop the promotion of all gambling websites, apps and digital advertisements in Pakistan and the FIA ​​should be ordered to investigate individuals and companies involved in gambling transactions.
