Larger bench formed to hear Kalbhushan’s request

Lahore, 7th August 2020: A three-member larger bench of the Islamabad High Court has been constituted to hear the petition regarding the appointment of Indian spy Kulbhushan Yadav’s lawyer.

A three-member bench headed by Chief Justice Athar Minullah of the Islamabad High Court (IHC) will hear the petition on September 3 in the Islamabad High Court (IHC). , Justice Mian Gul Hassan Aurangzeb will be present.

Following the International Court of Justice’s decision regarding the conviction of Indian agent Kulbhushan Yadav, the government had filed a petition in the Islamabad High Court to meet the requirements of the fair trial.

The petition further said that Kulbhushan Yadav had refused to appeal against the sentence, adding that Kulbhushan could not appoint a lawyer in Pakistan without Indian assistance, adding that India was also reluctant to avail the facility under the ordinance.

It is to be noted that Indian spy Kulbhushan Yadav was arrested on March 3, 2018, from the Pakistan-Iran border area. This Indian spy was working as a serving officer of the Indian Navy and an agent of RAW.

Following the arrest of Kulbhushan Yadav, the government of Pakistan summoned the Indian ambassador and formally protested against the illegal entry of Indian spies into Pakistan and their involvement in terrorism in Karachi and Balochistan. After this, the video of the confessional statement of Kulbhushan Yadav was released.

A case was registered against him under the provisions of terrorism in April 2018, a month after his arrest, after which a Pakistani military court convicted Kulbhushan Yadav of involvement in terrorist activities and sentenced him to death.

In May last year, India had filed a petition in the International Court of Justice (ICJ) seeking a stay of the execution of its spy Kulbhushan Yadav. The trial began on May 15 at the request of India, with the International Court of Justice in The Hague in the Netherlands hearing the case from February 18 to 21 at India’s request.
