Objection on Imran Khan’s Nomination papers, Hearing to be held today

PML-N comes to the fray against former Prime Minister (PM) Imran Khan, by objecting to his nomination papers for the upcoming elections.
Imran Khan had submitted the papers from Lahore’s Constituency NA 122. A former Member of the Punjab Assembly of PML-N, Mian Naseer Ahmed has raised objections to Imran Khan’s nomination papers. Mian Naseer Ahmed has filed the application through Advocate Supreme Court Mohammad Ramzan Chaudhary, Barrister Abdul Qudous Sohal.
In the petition of Mian Naseer Ahmed, it has been said that Imran Khan is convicted and is not eligible to contest the election, the nomination papers should be rejected. According to reports, the returning officer will hear the objection on Imran Khan’s papers at 2:00 pm.

In the petition of PML-N leader Malik Naseer Ahmed against the nomination papers of Imran Khan, referring to various court decisions, it has been said that the returning officer has the authority to fully examine the nomination papers and reject them if necessary. Regarding Imran Khan’s papers, it has been argued that his supporter is not a voter of Constituency NA 122. However, the papers submitted by Imran Khan from the jail are not confirmed by the Jail Superintendent yet.
In the application of Mian Naseer Ahmed, it was said that a trial was conducted by the Election Commission. He was sentenced under Sections 167 and 173 of the Election Act. On 05.08.2023, he filed an appeal against the decision and also filed an application. For the suspension of sentence (C.M. No.01/2023) the Islamabad High Court gave a decision after issuing notices to the parties and hearing the arguments of the parties. The Islamabad High Court rejected the request for suspension of sentence. Election Commission sentenced Imran Khan. Imran Khan cannot contest the election due to the punishment.

In the application of Mian Naseer Ahmed, it was said that the Returning Officer has the authority to reject the nomination papers under Section 62 of the Election Act. To maintain the integrity of the electoral process, it is necessary to ensure that candidates meet the necessary qualifications and comply with the rule of law. Referring to the court decision in the petition, it was said that in the case of Dr. Mubashir Hasan and others v. Federation of Pakistan, it was concluded that Article 63(1)(h) of the Constitution disqualifies a person. If convicted by a court of corruption, an elector, exercising his right to vote, trusts him. It is important for the representative not to betray the trust, he is disqualified if he is involved in the crime of corruption or moral turpitude. Legal requirements are necessary to comply with these legal provisions.
