LONDON: Pakistan International Airlines (PIA) wins landmark case at the Supreme Court of England in which a Pakistani travel agent in Birmingham was seeking commission of millions and alleging duress by the national airline.

According to the details, the national flag carrier won the economic duress case at Supreme Court of England after five judges unanimously ruled that PIA was right to use lawful act under economic duress on a British Pakistani travel agent. Farani Taylor Solicitors represented PIA in the case against the claimant Times Travel.

Times Travel, a British Pakistani travel agent in Birmingham, had approached the court against the PIA contract saying it was forced to sign a new contract in 2012 without paying a commission due to economic pressure.

Farhan Farani, counsel representing the national flag carrier, said that the matter was so serious that Russia and Ukraine also intervened in the matter as this judgment will have an impact on their case as well.

He added: “This decision effectively resets the boundaries of duress and will have major ramifications for commercial negotiations. The ruling is a defining moment for commercial negotiators.”

The ruling for Pakistan International Airlines means that it will not have to pay commissions retrospectively for the fuel surcharge part of the tickets. It is believed that a British Pakistani travel agent in Birmingham had filed a lawsuit against PIA, alleging that he was forced to sign a new contract in 2012 without paying a commission due to economic pressure.
