According to the report of Baaghi TV, the Pakistan Bar Council has filed a review petition against the decision of the Supreme Court in the matter of presidential reference against Justice Qazi Faiz Issa.
The Pakistan Bar Council has requested the Supreme Court to reconsider the June 19 decision. The petition lists the President, the Prime Minister and the Federal Minister of Law as parties. The petition also names the Supreme Judicial Council and Accountability Advisor Shehzad Akbar.
A review petition was filed in the Supreme Court through Advocate Salman Akram Raja.
On the same day of the Supreme Court’s decision on the presidential reference against Justice Qazi Faiz Issa, senior journalist and anchor person Mubasher Lucman had said that an appeal for review would be filed in the court, Baaghi TV had also reported from sources that the second appeal will be filed, and that the appeal has been filed today.
Senior journalist and anchor person Mubasher Lucman had also posted an analysis on YouTube after the Supreme Court’s decision, saying that it was true that supporters of Justice Qazi Faiz Issa would be happy with today’s decision. Mubasher Lucman says that those who think like this may have to face humiliation.
Senior journalist Mubasher Lucman said that many things are going against Justice Qazi Faiz Issa in the decision of this important case, but if you take a big point, then I find this case very interesting and also a comprehensive decision, he said. The Supreme Court has issued a landmark judgment in which the matter has now gone to the FBR.
He said that the FBR is a responsible and governmental body which in case of a Supreme Court decision would seek information from the wife and children of Justice Qazi Faiz Issa, it would also determine the legal status of these properties.
Mubasher Lucman says that the FBR will open up all the facts again. The other important thing is that the Supreme Court has given all these powers to the FBR in its decision and it is an independent body anyway. There will be important information regarding the case. If the wife and children of Justice Qazi Faiz Issa cannot prove that these properties are legal, then there is only one way for Justice Qazi Faiz Issa to resign.
Mubasher Lucman, while giving a very good analysis, said that he sees that in the future there will be many difficulties for Justice Qazi Faiz Issa and that too because of him. He said that the FBR has this case and all the evidences regarding it already exist.
Mubasher Lucman said, “I am very sure that the people who are following this case and the government officials who are dealing with this case are already aware of the statement recorded by the wife of Justice Qazi Faiz Issa.” That is why government officials are happy with the decision, which means that Justice Faiz Issa is now gone, he added.
Mubasher Lucman further said that as far as the implications of today’s verdict were concerned, if there had been another judge in place of Justice Faiz Issa, when would he have resigned, he said. After the FBR has been sent, there is no other way but to resign.
It should be noted that the Supreme Court granted the petition of Justice Qazi Faiz Issa, the Supreme Court annulled the presidential reference.
The Supreme Court ruled that the FBR should issue notices to the wife of Justice Qazi Issa regarding the property within 7 days. The notices of the FBR should be sent to the official residence of Justice Qazi Faiz Issa. Separate notice should be given, the judge’s wife and children will be parties in the FBR notice, FBR authorities should not even adjourn the matter, income tax should decide it in 7 days.
The court ruled that the Inland Revenue Commissioner would hear all parties, the Income Tax Commissioner should decide in accordance with the law, the FBR should submit a report to the Supreme Judicial Council within 7 days, and the Chairman FBR should provide all information to the Supreme Judicial Council. The decision was announced by Justice Umar Ata Bandial, head of the full court bench.
