SC Declares Petition Filed Against PLGA-2019 Maintainable

ISLAMABAD, July 13 (Online Int’l): Supreme Court  while declaring the petition filed against Punjab Local Government Act-2019 (PLGA-2019) as maintainable has issued notices to respondents.

A 3-member bench of SC headed by Justice Mushir Alam took up the case for hearing on Monday.

Nawazish Ali Pirzada, the counsel for the petitioner argued, “we have challenged only Punjab Local Government Act-2019. We don’t know about Sindh. All the elected representatives had taken an oath on December 31, 2016. The tenure of the elected representatives was 5 years under the constitution.  Punjab government defied different constitutional clauses by introducing a new act. My clients are elected representatives from different areas including Sahiwal, Lodhran, Sargodha, and Faisalabad.  The Government cannot enact such a legislation which creates a vacuum. The work of the entire state has stalled due to the local government act. The government could  implement this law after completion of tenure of the sitting elected representatives. All the powers of the elected representatives have been delegated to the administration.

 

Justice Mushir Alam remarked that perhaps some application has been filed with reference to the local governments of Sindh. Have you filed an application seeking suspension of the act? The counsel told the court that no separate application has been filed. It is requested that the case which is already fixed be heard. The court while declaring the petition filed against local government Act 2019 maintainable remarked “Give an application for stay order. The Court will issue the appropriate order.”

The court while issuing notices to the respondents adjourned the hearing of the case for an indefinite time.
