Supreme Court issues important order in Daniel Pearl murder case
Sindh government forced to accept court order.
According to Baaghi TV, the Daniel Pearl murder case has been heard and the Supreme Court has ordered the immediate removal of Ahmed Omar Sheikh and others from the death cell.
Ahmed Omar Sheikh was ordered to be removed from the death cell immediately, the Supreme Court ordered that the family will be able to stay together in the government rest house from 8 am to 5 pm. Ahmed Omar Sheikh should be kept in a rest house with security, mobile phone and internet facilities should not be provided.
Justice Umar Ata Bandial said that the detention of Omar Sheikh and other accused was malicious by the Sindh High Court. Is the main accused Omar Sheikh a Pakistani citizen or a foreigner? On which the Attorney General said that Ahmed Umar Sheikh has Pakistani and British citizenship, Justice Umar Ata Bandial said that detaining someone means keeping him in jail without trial. Justice Sajjad Ali Shah said that Daniel Pearl Even in the video of the murder, the face of the accused was not clear.
The court said that Ahmed Omar Sheikh should be kept in an open room in a better place in the jail for two days. After two days, Ahmed Omar Sheikh should be transferred to the Government Rest House. The accused should be provided comfortable accommodation and transport facility with Karachi family, all necessary arrangements should be completed in two days.
Advocate General Sindh said that the Sindh High Court had not issued notice to the Attorney General. The Attorney General said that the accused of Daniel Pearl case terrorized the whole of Pakistan and the federal and Sindh governments were concerned over the release of such terrorists. The nation has been badly affected by terrorism for years, incidents like the Machh tragedy have not happened anywhere in the world, Ahmed Omar Sheikh is a threat to the people of Pakistan.
Justice Umar Ata Bandial said that Ahmed Umar Sheikh should be proved to be associated with terrorists. Justice Sajjad Ali Shah while giving remarks said that Ahmed Umar Sheikh has been in jail for 18 years, what action was taken on the charge of terrorism? The attorney general said the state thought the Daniel Pearl murder case was a strong case against Ahmed Omar, who was studying at the London School of Economics.
Justice Muneeb Akhtar said that till yesterday your objection was that the High Court had not heard the federation, to which the Attorney General said that my real objection was to the notice. Advocate General Sindh said that the federal government was not represented in the Sindh High Court. Justice Muneeb Akhtar asked whether the Sindh government had objected to the lack of notice to the federal government in the High Court. On which Advocate General Sindh said that he did not raise any objection of non-representation of the federation in the High Court.
Justice Muneeb Akhtar said that the detention of the accused seems to be a provincial matter, adding that the federal government has delegated its authority to the provinces. Apparently, only the Advocate General of Sindh has to be given notice. The petitioner did not challenge the law that the Attorney General should be given notice. Apparently the Attorney General does not object to why he was not issued a notice.
It may be recalled that the Supreme Court had rejected the appeals of the Sindh government to stop the release of the accused in the Daniel Pearl case and ordered the release of Ahmed Omar Sheikh and other accused.
Later, the federal and Sindh governments decided to file a review appeal against the acquittal of the accused in the Daniel Pearl murder case.
It may be recalled that on April 2, the Sindh High Court, while ruling on the appeals filed by four accused in the murder case after the abduction of American journalist Daniel Pearl, had accepted the appeals of three accused while the main accused Omar Sheikh was sentenced to seven years and was turned into a prisoner.
The bench in its judgment granted the plea of the three accused and ordered their release, while the convict Ahmed Omar Saeed Sheikh alias Sheikh Omar had his death sentence changed to seven years imprisonment. Ahmed Omar Saeed Sheikh, who has been in jail for the past 18 years, was expected to be released after serving a full sentence of seven years.
However, on April 3, a major breakthrough came and the Sindh Home Department, at the request of the CIA DIG, remanded the four accused in custody for another 90 days. This is the second petition in the Supreme Court against the decision of the Sindh High Court in the murder case of a journalist. The Sindh government had on April 22 challenged the decision of the Sindh High Court in the murder case of journalist Daniel Pearl in the Supreme Court. On April 28, the Sindh government had approached the Supreme Court for an early hearing of its petition.
