NAB Ordinance: Disagreement gives rise to tensions

National Accountability Bureau (NAB) Ordinance has the offices heated up as a disagreement breaks out between the Law Ministry and the Attorney General’s Office over the bail clause on the new document.

According to government sources, the Attorney General’s Office was of the opinion that the amount of bail should be at the discretion of the court. However, sources have revealed that the law ministry was of the view that the amount of money in the case would be the same as the bail amount. The law ministry ignored the opinion of the attorney general’s office and added a clause in the ordinance.

According to the ordinance, the president will set up as many accountability courts in the country as he wants. He will appoint judges of accountability courts in consultation with the concerned Chief Justice of the High Court and the judges of accountability courts will be appointed for three years.

The ordinance also states,

“The president will appoint the chairman of NAB in consultation with the Prime Minister and the leader of the opposition. However, if there is no consensus, the president will refer the matter to the parliamentary committee. NAB will operate under the former Chairman Justice (Retd) Javed Iqbal, till the appointment of new Chairman NAB.”

Under the ordinance, all offenses will be non-bailable, only the accountability court will have the power to grant bail or release the accused. Also they will hear and settle the case.
