Delhi High Court to Hear All India Students Association President Neha Bora’s Plea on Urgent Basis

India: The Delhi High Court has agreed to hear today, on an urgent basis, a petition filed by All India Students’ Association president Neha Bora challenging a notice issued by a Special Executive Magistrate.

The notice directed Bora to execute a personal bond of Rs10,000 with a surety and “maintain peace” during the period of an inquiry. The case was mentioned for urgent listing and the court allowed the request.

Bora was detained on 16 October 2026 while on her way to participate in a protest related to demands for the resignation of the Chief Election Commissioner over alleged irregularities in the Special Intensive Revision of electoral rolls. She was released the following day.

Her petition argues that the notice, issued under provisions of the Bharatiya Nagarik Suraksha Sanhita, is vague, fails to specify any particular period or event linked to an apprehended breach of peace, and amounts to an improper use of preventive powers that infringes her fundamental rights to free speech, peaceful assembly and personal liberty under Articles 19 and 21 of the Constitution.

The High Court was on Dussehra vacation, making the decision to list the matter urgently notable.
