WASHINGTON (BBC) — September 22, 2026: CNN, MS NOW and Politico have filed a federal lawsuit challenging the Trump administration's decision to bar their journalists from the White House, escalating a dispute over media access and press freedom in the United States.

The three news organisations filed the case in the US District Court for the District of Columbia on Monday, seeking emergency judicial intervention and restoration of their access to the White House. They argue that the administration violated their First Amendment rights and denied them due process under the Fifth Amendment.

The organisations said in a joint statement that they were taking legal action to “defend the principle that the government does not decide what the press reports or publishes”.

They further alleged that the White House revoked journalists' credentials “without notice or process” because officials objected to their reporting, warning that leaving the restrictions in place could affect independent journalism and public access to information about government.

The dispute began after President Donald Trump announced that CNN, Politico and MS NOW would be barred from the White House. Trump accused the outlets of producing what he described as “fiction and lies” and subsequently defended the restrictions on his Truth Social account.

Trump said the outlets' reporting posed what he characterised as a national security concern and argued that the White House was not restricting press freedom but limiting access for organisations he considers unreliable.

Responding to the lawsuit, Trump referred to the organisations as “Fake News” outlets and criticised their coverage of his administration. His comments were made as the legal challenge was being filed in Washington.

Vice President JD Vance also defended the administration's position, arguing that the affected organisations could continue reporting on Trump without having what he described as “special access” inside the White House. The administration has maintained that the outlets were not being prevented from reporting, but were being denied particular access to the presidential premises.

The dispute also disrupted the White House television press pool, a system under which major broadcasters rotate responsibility for providing video coverage of presidential events and share that material with other media organisations.

ABC, CBS, CNN, Fox News and NBC said in a joint statement: “The public has a vital interest in receiving accurate, independent information about its government. No administration should restrict a news organisation because it objects to its reporting.”

The four other networks suspended their participation in the television pool after CNN was prevented from carrying out its scheduled pool duties. Fox News, which held the rotating responsibility for coordinating the pool, notified members that the television pool would no longer cover designated presidential events under the existing arrangement.

The decision meant that CNN could not provide its scheduled coverage of Trump's trip to New York for the United Nations General Assembly. Other outlets also temporarily withheld certain pooled material, including photographs, in response to the access dispute.

The White House subsequently launched a streaming operation known as “Trump TV”, providing administration-produced coverage as the traditional television pool faced disruption.

The case has been assigned to US District Judge Timothy Kelly. The outlets are seeking an expedited ruling and an order preventing the administration from enforcing the restrictions while the constitutional challenge proceeds.

The current dispute follows earlier clashes between the Trump administration and news organisations over access. In 2025, the White House changed the process governing the presidential press pool, taking greater control over which organisations could participate. The Associated Press has also been involved in separate litigation after its journalists were restricted from certain presidential spaces over its continued use of the term “Gulf of Mexico”.

The legal challenge is now before the federal courts, while the White House and the affected news organisations continue to offer sharply different interpretations of the restrictions. The court's forthcoming proceedings will determine whether the access ban can remain in effect while the broader constitutional questions are considered.
